Terms and Conditions

The service

XF Charts is a browser based platform that provides charts, orderflow market data, indicators, backtesting, journaling and related tools and educational content. We may add, change, suspend or remove features at any time to improve or maintain the service.

Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use XF Charts. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

Licence to use

Subject to these Terms, we grant you a limited, non exclusive, non transferable and revocable licence to access and use XF Charts for your own personal or internal business purposes.

• You may not resell, sublicense, rent or redistribute the platform or its data.
• You may not copy, reverse engineer, decompile or attempt to extract the source code or underlying data feeds.
• You may not scrape, mirror or use automated systems to access the platform except as we expressly permit.

Acceptable use

You agree not to use XF Charts for any unlawful purpose, to infringe the rights of others, to disrupt or compromise the security or integrity of the platform, or to gain unauthorized access to any systems or accounts.

Subscriptions and payments

Some features are offered on a paid basis. Where you purchase a subscription, you authorize us or our payment provider to charge the applicable fees. Fees are stated at the point of purchase and may be subject to taxes. Unless required by law or stated otherwise, payments are non refundable. We may change our prices on a prospective basis with notice.

Intellectual property

XF Charts, including its software, design, content, logos and trademarks, is owned by XFlow Trading s.r.o. or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. Content you create, such as your journal entries and annotations, remains yours.

Third party services

The platform integrates with third party services such as brokers, data providers and payment processors. Your use of those services is governed by their own terms, and we are not responsible for them.

Disclaimers

XF Charts is provided on an as is and as available basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error free or secure, or that any data will be accurate or timely. Please also read our General Risk Disclaimer.

Limitation of liability

To the maximum extent permitted by law, XFlow Trading s.r.o. and its team will not be liable for any indirect, incidental, special or consequential losses, or for any loss of profit, trading loss, loss of data or loss of goodwill, arising out of or in connection with your use of the platform. Nothing in these Terms limits any liability that cannot be limited under applicable law, including the mandatory rights of consumers.

Termination

We may suspend or terminate your access if you breach these Terms or where necessary to protect the platform or other users. You may stop using the service at any time. Provisions that by their nature should survive termination will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the platform after the changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the Czech Republic, and the courts of the Czech Republic have jurisdiction, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
